Non-conventional Patent Families for Chinese Dual Filings in INPADOC on STN

FIZ Karlsruhe Editorial created more than 330.000 non-conventional patent families for Chinese dual filings in INPADOC. This unique patent family information is of great benefit for users interested in legal protection in China.

Since 2009 the Chinese patent system allows parallel filings of a patent and a utility model at the same day for the same “invention-creation”. Companies make use of the dual filing strategy to achieve fast protection with the utility model application,
followed by a strong patent protection.

FIZ Karlsruhe Editorial makes use of the citation category “R” in INPADOC to establish the dual filing relationship in the INPADOC patent family. Based on this citation information more than 330.000 non-conventional family links have been generated up to now (07/2016).

The citation category R is assigned to dual filing utility models (CN U) cited by Chinese published applications (CN A), filed since February 2010. FIZ Karlsruhe Editorial adds the utility model application number as a technical priority to the related CN A publication to establish the family relationship.

The quality of this family building process depends on the availability of dual filing citation data in INPADOC. Whenever new citation category R information becomes available, families will be established.
